Welcome to SumaKey. By using our service, you accept these terms. Please read them carefully.

1. Acceptance of Terms

By registering and using the SumaKey service (the "Service"), you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, you will not be able to use the Service.

2. Description of the Service

SumaKey is a SaaS platform that allows businesses (the "Users") to create and manage digital loyalty programs. The Service includes:

  • Creation of digital loyalty cards for Google Wallet and Apple Wallet.
  • Customer management and points/stamps tracking.
  • Brand customization tools.
  • Dashboard with statistics and analytics.

3. User Accounts

To use the Service, you must:

  • Provide accurate and complete information during registration.
  • Maintain the security of your password and account.
  • Notify us immediately of any unauthorized use of your account.
  • Be at least 18 years old or of legal age in your jurisdiction.

4. User Responsibilities

As a User of the Service, you agree to:

  • Comply with all applicable laws, including data protection laws (GDPR).
  • Obtain appropriate consent from your end customers before registering them.
  • Not use the Service for illegal or fraudulent activities.
  • Be responsible for the content you upload (logos, descriptions, etc.).
  • Not attempt to access other users' systems or data.

5. Plans and Payments

The Service offers different subscription plans. When subscribing to a paid plan:

  • You authorize recurring billing according to the selected plan.
  • Prices may change with 30 days' prior notice.
  • Payments are non-refundable, except as required by law.
  • You can cancel your subscription at any time from your dashboard.

6. Intellectual Property

The Service and its original content (excluding content provided by Users) are the property of SumaKey and are protected by intellectual property laws. You retain all rights to your content (logos, brands, etc.).

7. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is", without express or implied warranties.
  • We will not be liable for indirect, incidental, or consequential damages.
  • Our total liability will not exceed the amounts paid in the last 12 months.

8. Service Modifications

We reserve the right to modify or discontinue the Service (or any part) with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of Spain, without regard to its conflict of laws provisions. Any dispute shall be submitted to the courts of Madrid, Spain.
